In order to protect its legitimate business interests with respect to this information, Aerotek requires that persons employed in aerocons to carry out professional recruitment and placement sign restrictive agreements and confidentiality agreements as a condition of employment. Aerotek also manages its customer and candidate information in secure password-protected databases. The evidence shows that Southern Network Services did not order Burton to provide services to Storage Technologies in accordance with the terms of the Aerotek agreement. Instead, Southern Network Services entered into a separate contract with Enterprise Solutions to allow that company to access Burton`s services. Finally, Enterprise Solutions entered into a separate agreement with Storage Technologies for the services that Burton actually provided. When Burton resounded its contract with Aerotek, it did not resume work for the customer under that contract, Southern Network Services, or at the facility where Southern Network Services had ordered it. He worked on a brand new project for Storage Technologies and worked from his home in Montgomery instead of going to the Birmingham office, as he had done during the term of the contract. By interpreting strictly the terms of Burton`s treaty with Aerotek, I conclude that Burton did not breach the restrictive agreement contained there in it. See Russell v. Birmingham Oxygen Serv., Inc., 408 So.2d 90 (Ala.1981). After Burton conducted a successful interview with Aerotek, after Aerotek obtained acceptable results in background and reference examinations, and after Burton underwent a drug test with satisfactory results, Aerotek Burton forwarded the CURRICULUM VITAE and reports on its benchmark examinations to Southern Network Services. Burton`s CURRICULUM VITAE and baseline review reports were in turn forwarded to Storage Technologies and BellSouth. The ensuing discussions with Burton through Southern Network Services and Storage Technologies were positive and, as a result, Burton entered into the employment contract with Aerotek on December 8, 1997, after which he began working at the BellSouth plant.
In accordance with their usual and industry practice, southern Network Services, Enterprise Solutions, and Storage Technologies each charged an additional fee for Burton`s services, and the final bill was paid by BellSouth.
